Only then can he search for and consider sponsoring or transferring an h-1b, but that also needs to be at that market rate. Searching for citizens at a below market rate is not grounds for sponsorship. Paying a below market rate or replacing citizens doing the same work is also illegal. Companies and recruiters game the system all the time. They will replace citizen consultants from one firm with h-1b’s from another, at half the rate.
